Ben Symonds Clarke gets hit by a car High school student Clarke Greenbank, who was previously struck by a car, has overcome the humiliation and abuse and is now back on top of the social scene. On September 11th 2008, Clarke Greenbank was biking from his house to Harry Miller Middle School, located in Rothesay New Brunswick. He was almost there, he rode up to the cross walk and made sure the cars stopped for him to cross, they did, and unfortunately one of the drivers did not notice Clarke.Clarke was hit by an oncoming car; he was tossed off his bike and landed on his back on the hood of the car, he then rolled off the car into the middle off the street. My Experience Essay As I reflect upon my life I will describe facts and events believed to have contributed to the person I am today. I like how Merriam Webster’s online dictionary explains experience as something personally encountered, undergone, or lived through. I have encountered difficulties, circumstances, and triumphs that have helped me to grow as a person. I am pursuing a higher education as my future goal. In this paper, I will apply theories from Adult Development and Life Assessment in my explanation of challenges I have faced during childhood to adulthood. I was born in Chicago, one of six girls and the middle child of twelve. As early as I can remember we worked as a group. We played together and we worked in the garden that my parents made in our back yard. I hated the garden because every time I wanted to go play, I first had pick vegetables out of the garden. I didn’t understand at the time that my parents used the garden to help feed our large family. My dad always worked two jobs; his primary employment was with a company called Central Soya. When my father retired from there we moved to Alabama because the cost of living was cheaper. We didn’t have a lot of material things like clothes and shoes. My mother would buy tennis shoes from the grocery store and my brothers would be so embarrassed because their friends saw them trying on the shoes in the store. I can remember my dad making me a pair of pants for school; I thought they were the prettiest pair of pants I had ever seen. It was cheaper to make a pair of pants than to buy them. My parents cut corners any way they could. We may not have had material things but what we did have was love and lots of talent. Not real talent but talent that’s appreciated in a family. On rainy days mom and dad would have us put on a talent show. It was so much fun that we kept the tradition even until adulthood. On birthdays and holidays we would use our talents to entertain mom and dad. Birthdays were especially special because my dad would make me a birthday cake. He was a really good cook and everyone in the neighborhood wanted a piece of his cake. My sixteenth birthday marked a significant shift in my life. I became pregnant and it was one of the biggest mistakes that started a downward spiral in my life. I hung out with older girls that had children. They were into partying and so called having a good time. Our environment plays a huge role in how we develop, what pathways are open to us, and which are closed (Witt, G.A., Mossler, R. A. (2010). I feel like the environment that I chose to be in led to early exploration of drugs and alcohol. I could see myself going in the wrong direction with more terrible consequences if I didn’t make a change. I stopped hanging out and got my first job. It was on a military base in the mess hall. I met a soldier and we got married on our way to work one day when I was twenty one years old. We dated for four months then he went overseas for a year. We married a year later after he returned to the states. Being married was a challenge because he was abusive physically, verbally, and mentally. I had listened to his insults for so long that they became part of my own vocabulary. I began to think that maybe he was right, maybe if I could cook, clean, dress or talk better it would fix our problems. In the beginning I rationalized everything he did, in rationalization: we look for an acceptable reason to justify our thinking or behavior (Witt Mossler 2010). I got involved in church and accepted the Lord Jesus Christ as my savior. According to Haan (1977), coping strategies involve choice and purposive behavior, are oriented toward reality, involve differentiated thinking that integrates conscious and preconscious aspects, and permit affective satisfaction in an open, ordered, and tempered way (Psychology and Aging 2000 ). It came to a point after seventeen years of abuse I couldn’t take it anymore. I had done all that I could physically to have a successful marriage but it wasn’t working out for me. I had to face the cruel reality that my marriage was over. Finally I filed for a divorce, which was one of the scariest things I have ever done in my life. Going through the divorce gave me a sense of freedom and strength that I had never experienced in my marriage. Getting a divorced was the best thing I could have done for myself. It started me on a journey to find out what I want out of life for myself. It marked a new beginning to a better, brighter future in my life. I was free to make my own decisions that impact my life. One of those decisions was returning to school for a degree. I really want to be an example to my daughter and her children that education is the key to success, and you are never too old to be successful in life. I must admit that I was very afraid of returning to school because I thought that I would not be successful. I thought that I wouldn’t be able to remember things or comprehend how to do the work. Some researchers contend that intellectual functioning is a process of irreversible decline. However, most scholars agree that intelligence either remains relatively stable through the adult years, with substantial intellectual changes occurring only very late in life, or that intelligence declines in some respects, remains stable in others, and may even increase in some functions, depending on a persons educational level, life experiences, and overall health (Intelligence and Aging 2007). I am now encouraged to pursue my education. I’m not too old, I plan to finish my courses and earn my degree. My goal is to apply for higher positions that require a degree. When I am engaged in art, I frequently look for works that allow me to escape from my hectic lifestyle. Clean lines and use of space appeal to my senses and calm me. Sometimes, what is not stated says more than what is stated. I have learned from my study of Japanese art history this semester that simplicity seems to be a common theme in many of the artworks produced throughout Japan’s rich history. Of course, this is not always the case; there are plenty of works that are colorful and loud. Use of color, in fact, seems to be an appreciated value in much of the art I have seen. However, there seems to a simplistic nature in even the most complex of Japanese artwork. This minimalism appears to be an appreciated Japanese aesthetic. Two works of Japanese art stood out to me this semester, precisely for their minimalistic nature: Pine Trees by Hasegawa Tohaku from the late 16th century Momoyama period, and a Shoki-Imari sake bottle from the 17th century Edo period. While there are many differences between these two works, they appear to complement each other. Each of these works has a rich history behind its creation and they both convey a sense of complex simplicity. Before diving into the two works of art presented in this essay, a brief overview of the periods that spawned these artworks is necessary; specifically the relationship of the Momoyama and Edo periods with painting and ceramics, respectively. 1. Momoyama Background Artistically, the Momoyama period (1568-1615) was the most important half-century period in the history of Japan (Swann 211). Momoyama means â€Å"Peach Blossom Hill,† and the period drew its name from the flowering peach trees, over-looked by the great Fushimi Castle, which was frequented by the local residents of the prefecture (Hickman 19). Hickman states, â€Å"[The term, Momoyama] seems appropriate†¦ for the vision of a brilliant cloud of evanescent peach blossoms serves well as an evocative visual metaphor for the period, a ‘golden age’ of short duration but memorable accomplishments,† (19). The period was fraught with intense warfare between clans, and the emperor remained powerless, but the Momoyama laid the foundation for a modern Japan that would experience over two hundred and fifty years of peace in the Edo period. Momoyama’s art was defined by color and movement that took the place of previously used monochrome and stillness (Swann 215). Artists suddenly felt free of restraint and were free to breath new life into old themes and form original interpretations (215). Color, gold and silver were frequently used in art. The Kano school style of painting gained prominence. Folding screens, covered in paper with bold paintings, became increasingly popular. â€Å"Perhaps [The Momoyama’s] most important product is among the most conspicuously decorative works ever produced†¦ a movable and flexible wall of dubious utilitarian value, but perhaps the most significant creation of the Japanese decorative style,† (qtd. Swann 216). The large area of the folding screen lent itself to broad, sweeping brushstrokes and immense designs. The Momoyama period attempted to bring nature into the household. 2. Hasegawa Tohaku Hasegawa Tohaku (1539-1610) was born in Nanao in the province of Noto (Tazawa 83). He was a painter of the Momoyama period who was able to paint in both Chinese and Japanese styles (Swann 219). Before he took the name Tohaku, he went by the name Shinshun and mainly produced portraits and Buddhist paintings (Tazawa 83). Hasegawa Tohaku was highly skilled and studied the works of Sesshu, Shubun, Kanga, the Kano school and Song and Yuan Chinese dynasty painters (83). Much of his work represented the style of the Momoyama period – flowering trees, flowers, and bright colors. However, his most famous paintings, like Pine Trees differ greatly from the typical Momoyama style (Seiroku 107). . Edo Background The Edo period (1615-1868) is distinguished by the long rule of the Tokugawa clan and an era of political stability. The period is called Edo since the capital was moved from Kyoto to the small village of Edo, which later became Tokyo. Two important developments influenced the subsequent artistic developments of the Edo period. First, in the Edo period Japan beca me completely isolated from the rest of the world by closing its borders to foreigners (with a small exception to some Dutch and Chinese near Nagasaki) and prohibiting foreign travel (Swann 239). Since the Chinese had historically influenced the Japanese, artists were now able to move towards the rejection and free adaptation of Chinese influences (Watson 260). The closed borders also removed the Western and Christian influences which had been slowly filtering in through the Dutch. As feudalism declined in the West in favor of the creation of parliamentary systems, Japan feverishly worked to pursue, â€Å"pleasure and extravagance which is most vividly reflected in the arts,† (Swann 240). The pursuit of the arts gave way to the second major Edo development the rise of the merchant class, which affected the artistic patronage and ushered in the Edo artists. New patrons allowed art to flourish in the Edo period. The new city of Edo helped create this new class of merchants that were able to supply not only the samurai, but themselves as well. This opened new and wider markets for the creations of artists and craftsmen (Swann 243). 4. Shoki-Imari ware One of the greatest influences to Japanese ceramics was Hideyoshi Toyotomi’s invasion of Korea at the end of the Momoyama period (Watson 260). The Japanese still wanted to produce ceramics that represented the greater Asiatic cultures, so the returning Japanese armies brought back Korean potters (Sanders 44). This led to a tremendous advance in ceramics of the early 17th century, allowing for the proliferation of porcelain (Watson 260). There were several innovations of porcelain throughout the Edo period, but for the purpose of this paper, only the Shoki-Imari ware will be discussed. Arita became a town in the Saga prefecture of Japan known for porcelain production after a discovery by a Korean potter in the early 17th century (Sanders 44). The earliest porcelains, called Shoki-Imari, were made out of a poor quality clay, with a high iron content (Watson 261). These Shoki-Imari were typically decorated with an underglaze of cobalt oxide, which had a bluish tinge. The decorations were often flowers or landscape of Korean influence (261). However, the Japanese still envied the enameled porcelain of the Chinese Ming Dynasty and finally by the mid 17th century the Arita potters learned how to use an overglaze to produce that effect. Both the underglaze and the overglaze porcelains were able to proliferate to Europe through the very limited trade with the Dutch. . Pine Trees and the Shiko Imari sake bottle The first thing one notices about Hasegawa Tohaku’s screen painting, Pine Trees, is that the entire painting is monochromatic and you can easily see how little of the canvas is used. There is more space than ink, or in terms of the environment, more mist than trees. This presents a sense of openness, almost an empti ness in the painting. According to Tazawa, â€Å"In no other work, perhaps, has the poetic quality inherent in Japanese style ink painting been so successfully realized,† (84). The same sort of feeling of Pine Trees is immediately seen in the Shoki-Imari sake bottle. The sake bottle is also monochromatic and the porcelain gleams all around the sparseness of the landscape presented. It has the same sort of emptiness as Pine Trees. This emptiness is interesting in the sake bottle because the use of the open space makes the bottle seem empty inside. Both pieces of art are similar in the sense that they present a landscape, which is a common Japanese aesthetic, especially of those time periods. The artist of the Shoki-Imari bottle is unknown, but it is clear that he was familiar with the environment he was painting. Both pieces of art make the viewer feel they are inside the painted scene, even if one piece is small and the other is large. Both works create environments that are simple and direct in their reference to an ageless Japanese reality (Seiroku 107). One element the sake bottle presents that Pine Trees does not is the bottle uses a man-made element it its scene; the sake bottle has a pagoda painted on it. This element causes the viewer to feel as if man had been inside the portrayed environment where Pine Trees does not. Pine Trees leaves the viewer feeling that no one had ever been inside the forest. The use of the mist helps enforce this feeling. It gives it a haunted, untouchable feel. The sake bottle landscape makes the artwork feel approachable. Another difference is that the techniques used in Pine Trees are distinctly Chinese. The techniques used in the creation of the Shoki-Imari Sake bottle were Korean. However, since the Japanese wanted to create ceramics in the manner of the Chinese, the underglaze was painted on in a Chinese style. This specific Shoki-Imari piece however, was not part of the first Shoki-Imari created, since it was formed sometime between 1650 and 1660 (Watson 267). It is in the style of the first porcelains exported by the Dutch, but was created later for the international market; Arita had already ceased production on poorer quality Shoki-Imari ceramics (267). Since the Japanese had already mastered overglaze technique by this time, this bottle was made purposefully with underglaze. The blue and white design was an aesthetic of the Chinese the Japanese were trying to master and created this vase to replicate earlier Chinese models (267). The painting styles of the two pieces of artwork are similar and different. In Hasegawa Tohaku’s Pine Trees, the ink was skillfully applied with â€Å"varying degrees of thickness to create the effect of pine trees partly hidden in mist, the work as a whole giving a strong sense of economy, vividness, and clarity of conception,† (Tazawa 84). Some of the ink of the trees is so dark that some individual branches are indistinguishable, yet they seem closer and more clear than those painted lightly. In some parts of the painting, there is nothing painted at all, but it is still clear that the forms of the trees are still there, even if only implied. For the most part, the use of hue in Pine Trees is not the same as the Shoki-Imari sake bottle. Some parts of the trees are painted darker than others, but only to give the individual trees added detail. There are some varying hues of the mountains and land in the bottle, but not in the same sense as Pine Trees. The mountains are not painted in detail either; they are only outlines, leaving the inside hollow. The lightest object on the entire bottle is, surprisingly, the man-made pagoda. The lightness of the pagoda assumingly expresses the Japanese respect for a nature. Each piece of artwork has something in common and something different in the way they portray the tree branches. In Pine Trees, Hasegawa Tohaku curves the branches, sloping toward the ground. But at the same time, there is a slight element of the Ma-Yuan Chinese influence on Japanese painting. The trees have a slight angular nature to them. It is not something that is noticed at a mere glance, but upon further study, you can see the implied angular nature of an older style of painting. He clearly studied the style and made it his own. The brushstrokes imply a hidden angularity in the forest. The Shoki-Imari sake bottle does not use any angularity, but it has another interesting element. The two trees in the foreground sit at an angle and curve with the roundness of the bottle. The mountains also protrude into the neck of the bottle. This method of following the lines and curves of the bottle makes the environment seem more real by conforming to the three dimensional object. Another element that the two pieces of art have in common is depth. The Shoki-Imari sake bottle certainly does not use a thickness in the brushstrokes to convey this. It conveys depth by the placement of the objects. The mountains are painted above the tree line with little overlap. A river flows from the base of the mountains to the middle of the bottle where the pagoda is located in the middle of the tree. The tree come up from the ground at an angle and curve to either side so that they have varying heights. The combination of each of these elements puts the trees in the foreground and the mountains in the background, with the pagoda and some vegetation in the middle. This creates a sense of depth, which was a newer element in Japanese art. Each of the brushstrokes on the bottle is deliberate and creates line for the eye to follow. Hasegawa Tohaku’s painting creates depth, if not more so than the bottle, but by using a different technique. The varying levels of ink he applied to the trees and the lack of ink used in the midst creates an intense depth. It is presumable that all of the trees are planted at the same relative level, but by having the darker trees at varying heights and painting the other trees at varying hues, he created an incredible amount of depth on a flat surface. He created a forest from a row of trees. 6. Conclusion The Shoki-Imari sake bottle and Hasegawa Tohaku’s Pine Trees are obviously very different pieces of art. Pine Trees is ink, black and white, large, on a folding screen and from the Momoyama period. The Shoki-Imari sake bottle is porcelain, underglazed, small, blue and white and from the Edo period. They were created roughly fifty years apart. However, they both express a minimalism that reflects an essence of Japanese aesthetic. Both pieces of art say more with what is understated. They are simple pieces; but the history behind these works and the processes involved are incredibly complex. I find both them both incredibly powerful, peaceful and refreshing.

The Importance of Self Awareness and Effective Interpersonal Skills in an ECCE setting: Self-Awareness is important within an ECCE setting as it allows you as a childcare practitioner to know your weaknesses, strengths, personality, beliefs, and also allows you to reflect on different situations. You will be looked up to by children from all different age groups and you need to be a good role model and have the realisation of when to change the mood or maybe even your body language to suit the current environment. Through using self-awareness techniques it allows you to look at yourself through other people’s eyes and then to maybe make changes about yourself to suit your professional role within the ECCE setting. Self-awareness is crucial as how you handle yourself when dealing with children will slightly differ to how you represent yourself when dealing with their parents or colleagues. Interpersonal Skills play a big factor within an ECCE setting as it is a key role of all childcare practitioners. To be able to communicate effectively with children, parents and colleagues makes the job in hand easier to achieve. Some valuable steps to having good interpersonal skills are: Always smile as this gives off good energy and makes people comfortable and happy to be in your company. Always try to be positive and encouraging with all people within the workplace i.e. with children and adults. Ensure to take time to listen and observe peoples behaviours or actions, this will enable you to get to know and understand people on a more personal level. Always try to inject a fun atmosphere within an ECCE setting as this gives an overall feel good factor and makes the environment a more enjoyable place. The Rights of the child in the context of an ECCE setting: The United Nations convention on the rights of the child legislation came about in recognition of the importance for children to be respected and valued. This piece of legislation helps us require a recommended standard within the ECCE setting. The following will outline some examples: To maintain children’s right to privacy and dignity always ensure when changing a child’s nappy to do so within the private nappy changing area or if a child should have a toilet accident always make sure to cover them up be as discreet as possible to avoid embarrassment and maintain the child’s dignity. This links in with the UNCRC legislation article 16 which says that children have the right to privacy. Maintaining safety within the ECCE setting is a very crucial step and is carried out in many different ways through door buzzers, CCTV systems, following the recommended child to adult ratio and Garda vetting of all staff. This links in with article 19 within the UNCRC legislation which states all children should be properly cared for. Any disabled child joining an ECCE setting should have their needs catered for and be able to participate freely and independently within the setting. E.g. if a child is in a wheel chair the childcare setting should ensure everything is easy accessible and at the child’s level so he/she can use facilities and toys at their leisure. This links in with article 23 in the UNCRC legislation. Communicating effectively with the children, family and colleagues: Most childcare practitioners realise the importance of having a good relationship with a Childs parents. Working with, involving and informing parents in the daily activities of their children helps to stabilise a good relationship and partnership between both parties. We should always ensure to make parents feel welcome through having parent days and informing them of milestones and progression with their children we can implement this through parent teacher meetings to set down a specific allocated time to discuss the child’s development. Communication with the child/children within the ECCE setting is our number one priority as the child is our main concern so looking out for their health and safety, their happiness and over all well-being is crucial. To ensure a high quality level of communication is enforced it is up to us to always listen to a child with our ears as well as our eyes, to always come down to their level when speaking to them and most important to make sure they feel comfortable and safe in your presence. Communicating with your work colleagues is a must as everyone needs to know what everyone else is doing to ensure a smooth running of the centre. It is up to each childcare practitioner to have a good understanding of the workplace rules and polices so everyone is inflicting the same polices throughout. This can be done through filling out forms accurately and always ensuring to inform your colleagues of any major incidents like if a child falls or you have administered a child with medicine. Examples of effective teamwork: Administering Medication is one example where teamwork within the ECCE setting is essential as if you do not communicate with your team members that you have administered a child with their medication the dosage and the time you administered the medication it could lead to a child being over dosed or not getting the correct amount at the correct time. Planning an outing within the ECCE setting involves a lot of teamwork and planning. Through teamwork everyone knows what is expected of them and their role throughout the outing to ensure all of the children’s safety and well-being needs are catered for. Team members will be involved in the issuing of permission slips, booking a bus, ensuring the correct child- adult ratio is enforced and maybe a bit of brainstorming on the events that will take place on the day. Putting an End of Year Concert together also involves a lot of teamwork as everyone will work together to pick out roles, costumes, music and themes for the children. There will be informing of the concert to the families of the children involved. Then there will be ensuring that the concert runs according to plan in accordance with the concert programme. The team members will be on hand to help or reassure the children throughout the performance. Child protection cases that may arise is one great advantage when it comes to teamwork. This allows you to gather information and relay it back to your team members where they in turn will give you their opinion or advice on the situation and then as a team ye will make a collective decision on what action if any is needed. Maintain a quality ECCE environment that complies with relevant regulations and standards: Here are a few examples of how to maintain a quality ECCE environment using à istear regulations and standards: By organising a simple activity by where a child uses sand to draw shapes, numbers and pictures allows the child to communicate through play and through the use of their imagination. Then to get the child thinking about what they drew get them to explain their picture while asking questions that will get them to think how their picture relates to life and how people can read and understand their picture through the use of visual senses as well as language. This links in with à istear’s communicating theme aim 3 and learning goal 3 which states â€Å"children will broaden their understanding of the world by making sense of experiences through language. Another good and interesting activity to do with children that would make them aware of nature and also of well-being would be to make bird feeders with pieces of string allowing the child the tread through pieces of food e.g. blueberries, cheerio’s, etc. and allow the child to put the feeder out for the birds to eat. This creates great interest in animals and the need to look after them an also gives them a good example of why different foods especially fruit is good. This links with à istear’s principle of learning and developing within a holistic need for children. By getting the children to participate in a family wall chart or birthday chart links in with à istear’s theme identity and belonging aim 2 which states â€Å"children will have a sense of identity, where links with their family and community are acknowledged and extended. Nick Carraway’s Look at Man   Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  Nick Carraway, the first character introduced in Fitzgerald’s The Great Gatsby, is primarily acts as the â€Å"guide and pathfinder†; he relates the story from what others have told him. He strives at all times to be objective, and his comments are balanced. His amusingly contemptuous remarks show his sense of humor, and although he is straight-laced, he does not bore the reader. Nick is introduced directly, but Gatsby remains a distant character for a good while. The establishment of Nick’s reflective, tolerant personality is essential, as are his limitations, so the reader doesn’t just dismiss him as Fitzgerald’s mouthpiece. The fact that he disapproves of Gatsby so early on helps the reader to go along with his judgments when he tells of Gatsby and unfolds the story.   Ã‚  Ã‚  Ã‚  Ã‚  The first mysterious glimpse of Gatsby prepares the reader for much of what is to come. The imagery of â€Å"silhouette,† â€Å"moonlight,† and â€Å"shadow† in this passage prepares the reader for Gatsby’s shadowy, dark character. Many more of his actions appear to the reader, and Nick, as â€Å"curious.† The fact he is‘ trembling’ shows he is intense in his emotions-- and none of this is for show; Gatsby believes he is alone. His concentration on the â€Å"single green light† represents his determination to succeed, his constant drive; everything is designed so he can be with Daisy. He then vanishes; echoing the end of the book.   Ã‚  Ã‚  Ã‚  Ã‚  Nick is unlike the other characters of the book; he is not one of the â€Å"careless people.† He has a conscience, he is not selfish-- he has decency, which is well demonstrated in his efforts for Gatsby’s funeral. His down-to-earth character shows how superficial Daisy and Tom are. They are ruthlessly practical, where as Gatsby is a hopeless dreamer. Nick guides the reader between these two extremes while remaining a detached observer whilst being involved in the action-- â€Å"I was within and without, simultaneously enchanted and repelled by the inexhaustible variety of life.†   Ã‚  Ã‚  Ã‚  Ã‚  Nick’s aim to be truthful and objective makes the reader trust him. When Nick says Gatsby has a â€Å"rare smile with a quality of eternal reassurance in it,† the reader knows his riches or parties, but is telling it to the reader straight aren’t charming Nick. His contempt for much of what Gatsby says, but also Nick’s tolerance, is emphasized when Nick doesn’t mock him-- ‘â€Å"I lived . .

Free Speech or Just Offensive? A highly debated topic as of late has been the staggering rise of offensive language and topics of the music industry, which have infiltrated through. Should the artists of this music be punished for corrupting the minds of the people who listen to it? Or should the musician's rights be protected by the first amendment? The main problem to be seen is that this music has become extremely popular to the youth. With this popularity comes blow after blow from the media, parents, and organizations putting down the music because they believe it's corrupting the children. All of these criticisms towards music have even made the government step in and put parental advisory warnings on the CD's. This lets the consumer know that the CD they are buying has adult language, violence, or sexual references in the songs. The government has also set an age minimum of seventeen years old to even purchase the offensive CD's. After all of this is said and done, the albums are still selling millions of copies. It is a whole different market today, set on exploiting the rebels "fuck you I won't do what you tell me" attitude of the youth. "Big bucks is the name of the game.† says music critic Harvey Bickle. This implies that these stars that have risen from this music are only doing so to make themselves a quick buck. Whether or not this is true, we still support these stars and will continue to do so. But is there any evidence that the music is hurting anyone? Many reasons offensive music has been blamed can be documented through past incidences. During the Columbine shooting, the media was blaming the music of Marlin Manson because of his dark songs. This idea of music creating violence is not a new one. In 1982 ACDC put out a song called Night Stalker on their album. Later on that year, a killer roamed the countryside while assuming the alias Night Stalker, and was convinced that the lyrics from ACDC's song drove him to do these disgusting acts of murder. Many cases like this have been brought to court, but notably, not one has proved their case against the artist. How could we come to the conclusion that the music caused these mass killings and riots a... ...r a redress of grievances." (Duemler, David 34). This basically means that as an artist or regular person, one may speak or illustrate anything without being punished or revised as long as it is done so in a respectable manner. There is even an entire organization supporting and fighting for the first amendment for artist called the Recording Industry Association of America, or RIAA. It is ironic that the amendment that protects the artist is also the amendment that allows people to protest against it. Overall the point is that most of our basic laws come from these amendments, and they are what America was built on, so how can we accuse artists of breaking the law when all they were doing was following it? Although the music industry is becoming more and more controversial, it still does not give anyone the right to ban or prosecute someone’s music, because an artist has the right to a freedom of expression. People who disagree with this, can choose not buy the music or change the station when it's on the radio, but they cannot destroy it or the artist because freedom of speech is what makes this country so great and free.

Also known as â€Å"Dule† Tadic, this former leader of Serbian paramilitary forces has been indicted in 1995 . The Defence team had fulfilled a preliminary motion for dismissal of the charges based on the tribunal lack of jurisdiction which was primarily rejected by the Trial Chamber which refused, amongst others, to investigate the legitimacy of the creation of the tribunal . From this dismissal, the Defence team filed an interlocutory appeal to contest, amongst others, the â€Å"illegal foundation of the International Tribunal .† ISSUE Dusko Tadic (hereinafter the Appellant) contested the jurisdiction (or the â€Å"competence† as it is referred in the French version of the case) of the International Criminal Tribunal for the former Yugoslavia (ICTY) and alleged â€Å"an error of law on the part of the Trial Chamber †, and contested particularly the legitimacy of the establishment of the Tribunal. Therefore the questions are the following.
